By participating in this competition (the “contest”), you (“contestant” or “entrant” or “you”) agrees to abide by the following Official Terms, Conditions and Rules, including all eligibility requirements, and understands that the results of the competition, as determined by Sponsors and their agents, are final in all respects.

End Date: Friday March 30, 2018 at 5.00pm AEDT

Item 3 – Prize Details
One (1) prize winner within Australia (excluding ACT), who will receive the following:

  • A trip to Las Vegas, USA, for the winner and their chosen one (1) friend, inclusive of:
  • x2 return airfares from the winner’s nearest capital city;
  • x3 nights’ accommodation (twin-share) in Las Vegas (May 3, 4, 5); and
  • x2 tickets to the final round of the 2018 Monster Energy AMA Supercross, an FIM World Championship (includes press box access, track walk experience), at Sam Boyd Stadium in Las Vegas on Saturday May 5, 2018

Total prize value is up to $6000 (including GST), depending on point of departure.

Item 4 – Rules of Entry

Who can enter?
Entry is available to any current Transmoto Tribe Member who are residents of Australia aged 18 years but excludes:

  • residents of Australian Capital Territory;
  • employees of the promoter, any sponsor connected with the competition or any other related parties.

Who is running this competition?
The promoter’s details and associated parties are listed in Item 1 above.

What kind of competition is this?
This competition is a free game of chance.

How can I enter?
If you are an eligible  Transmoto Tribe member then your entry is automatic – nothing further for you to do.
If you are not a member already memberships can be obtained via www.tribe.transmoto.com.au.

When do entries into the competition close?
Entries will close at 5pm AEST on March 30, 2018.

When will the prize be drawn?
The prize will be drawn on April 2, 2018, at 3pm AEST at 681 Barrenjoey Road, Avalon NSW 2107. The first valid entry will receive a prize. The promoter’s decision is final and no correspondence will be entered into.

What happens if I no longer wish to take part in the competition?
You need to advise the promoter in writing.

How do I know if my entries have been accepted?
Your entry will be deemed acceptable once you create your account and have paid in full for a Transmoto Tribe Membership. The promoter takes no responsibility if your entry is lost, late or misdirected. The rromoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the promoter’s sole discretion. Failure by the promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

What happens once my entry is received?
Your entry will become the property of the promoter who may use your personal information in order to conduct the competition. The information you provide, unless you advise the promoter in writing and the promoter confirms its receipt (also in writing) will be stored and entered into a database and may be used for future competitions, marketing, and publicity purposes in any media without notice and without any fee being paid. The information you provide, unless you advise the promoter in writing and the promoter confirms its receipt (also in writing) may also be supplied to our third partner sponsors of this competition. Entrants consent to the promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the promoter.

What happens once the winner is drawn?
The winner will be notified by email and a phone call within 24 hours of the draw taking place. The winner may also be published on the Transmoto social media platforms within 48 hours of the draw taking place. If necessary, a second chance draw will be held on April 2, 2018, at the same time and place as the first draw(s) in order to distribute any unclaimed prize. Winner will be notified by telephone and email within 2 (two) days of the second chance draw.

What are the dates of travel for the trip?
The dates of travel are May 3 – May 6, 2018.

Can I change the dates of the trip?
No, the winner must be able to attend all dates of the trip. The prize is non-transferable, the date cannot be changed, and cannot be redeemed for cash.

What is the value of the prize?
Please see Item 3 above. The total value of the prize is in Australian dollars and includes GST and is based upon recommended retail values provided by each supplier, correct at the time of printing. The promoter accepts no responsibility if the value of the prize changes.

Is there more than one winner?
There is only one (1) winner and one (1) prize pack for that winner. The prize cannot be transferred shared or redeemed for cash.

How do I claim the prize?
The prize package must be claimed within seventy-two (72) hours of the winner being published. If the prize remains unclaimed or the winner is unable to accept the prize (for whatever reason), the winner will forfeit their prize and will have no claim. The promoter reserves the right to re-award at the same location such unclaimed prizes within seven (7) days of the original prize being awarded. In the event of a re-allocated winner, their details will be published on the promoter’s website within twenty-four (24) hours of the re-award. As a condition of accepting a prize, each winner (and his/her companions) must sign any legal documentation as and in the form required by the promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

What is not covered in the cost of the prize?
All expenses (including but not limited to delivery, taxes and insurances) become the responsibility of the winner unless otherwise stated in the prize description in Item 3 above.

What will I get if the original prize is unavailable?
If any prize (or part of any prize) is unavailable, the promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

What happens if my prize/elements of prize are damaged or lost?
The promoter and its associated agencies and companies take no responsibility if the prize is delayed, damaged or lost in transit.

Are there any tax implications?
Sometimes this may happen. You may wish to seek independent tax advice prior to accepting the prize.

What happens if I incur a loss or damage from the prize?
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia. Except for any liability that cannot by law be excluded, the promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including: (a) any technical difficulties or equipment malfunction (whether or not under the promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the promoter) due to any reason beyond the reasonable control of the promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize and/or participation in any holiday prize.

What can alter or prevent the competition from taking place?
The promoter is not responsible for any incorrect or inaccurate information, either caused by:
– defects, delays and any other problems affecting technical equipment or telecommunication systems or infection by computer virus, bugs, technical failures or any other causes beyond the control of the promoter;
– tampering, unauthorised intervention, fraud or intervention of any outside agent or event which naturally changed the result or presents or hinders its determination, including but not limited to: vandalism, power failures, civil unrest, strikes, tempests, natural disasters, acts of God.
 

Can I be excluded from the competition?
The promoter can disqualify any individual who the promoter has reason to believe has breached any of these conditions and/or engaged in any unlawful or other misconduct calculated to jeopardise the fair and proper running of the competition.

Can I cancel my Transmoto Tribe Membership Account after entering and/or if I am the winning entrant?
If membership is cancelled at any point prior to the competition completion and/or trip to Las Vegas, entrants/winner forfeits all rights to prize fulfilment.

What travel documents are required?
The one (1) winner and their one (1) friend MUST have a valid passport with a minimum of 12 months’ validity for International Travel and be able to travel to the USA.

Does the competition include travel insurance?
No, this is the responsibility of the one (1) winner and one (1) friend.

Does the competition include travel to the departing airport?
No, the one (1) winner and one (1) friend are required to cover the travel to and from the capital city in which the flights departs Australia.

Is the winner able to choose airfare & accommodation details?
Subject to the above terms and conditions the promoter reserves the sole and absolute discretion as to selection of all prize details including accommodation and travel arrangements associated with the prize but the promoter may, but is not obliged to, liaise with the winner if any options exist.

Are these the final terms and conditions of the Competition?
These Terms and Conditions are subject to change at any time without prior notice and will be updated on the promoter’s Website.
