TERMS AND CONDITIONS

By participating in this competition (the “contest”), you (“contestant” or “entrant” or “you”) agrees to abide by the following Official Terms, Conditions and Rules, including all eligibility requirements, and understands that the results of the competition, as determined by Sponsors and their agents, are final in all respects.

Item 3: Prize Details 

One (1) prize winner within Australia, who will receive the following:
– Complimentary team entry for a maximum of 4 people into all Transmoto Enduro Events in the 2020 season.
– A 2020-model Husqvarna FE450 motorcycle.

Total prize value is up to $22,105 (including GST), depending on team category chosen.

Entry is available to Australian Residents only, aged 18 years and over.

FAQs ANSWERED

How can I enter?
Individuals can enter by signing up and becoming an active member of Transmoto Tribe. Entrants can choose from two subscription options: $98/year without member pack, or $159/year with member pack. Entry is also open to all active existing members of Transmoto Tribe.

Who is running this competition?
The Promoters’ details and associated parties are listed in Item 1 of the Annexure.

Who can enter?
Entry is available to Australian Residents only, aged 18 years and over (Item 4).

What kind of competition is this?
This competition is a game of chance.

How do I know if my entries have been accepted?
Your entry will be deemed acceptable once your Transmoto Tribe membership status is ‘Active’. The Promoter takes no responsibility if your entry is lost, late or misdirected. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

What happens once my entry is received?
Your entry will become the property of the promoter who may use your personal information in order to conduct the competition. The information you provide, unless you advise the Promoter in writing and the promoter confirms its receipt (also in writing) will be stored and entered into a database and may be used for future competitions, marketing, and publicity purposes in any media without notice and without any fee being paid. The information you provide, unless you advise the Promoter in writing and the promoter confirms its receipt (also in writing) may also be supplied to our third partner sponsor of this competition, Husqvarna. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

When do entries into the competition close?
Entries will close at 12pm AEDT Monday, February 3, 2020

When will the prize be drawn?
The prize will be drawn Monday, February 3, 2020, by 5pm AEST at 681 Barrenjoey Road, Avalon, NSW 2107. The first valid entry will receive a prize. The Promoter’s decision is final and no correspondence will be entered into.

What happens once the winner is drawn?
The winner will be notified by email and a phone call within 24 hours of the draw taking place. The winner may also be published on the Transmoto social media platforms within 48 hours of the draw taking place. If necessary, a second chance draw will be held on February 3, 2020, at the same time and place as the first draw(s) in order to distribute any unclaimed prize. The winner will be notified by telephone and email within two days of the second chance draw.

What happens if I no longer wish to take part in the competition?
You need to advise the Promoter in writing.

What are the dates of the 2020 Transmoto enduro events?

  • Feb 29-March 1: Transmoto 12-Hour @ Batemans Bay, NSW
  • April 4-5: Transmoto 8-Hour @ Coffs Harbour, NSW
  • May 16-17: Transmoto 8-Hour @ Secret Venue (TBA)
  • June 27-28: Transmoto 6-Hour @ Nabiac, NSW
  • July 25-26: Transmoto 6-Hour @ Conondale, Qld
  • August 22-23: Transmoto 8-Hour @ Wangaratta, Vic.
  • October 10-11: Transmoto 8-Hour @ Stroud, NSW

What happens if I cannot make one or all of the 2020 Transmoto Enduro events?
In the case that you are unable to attend one or all of the 2020 Transmoto Enduro Events, you will forfeit your team entry. Entries are not transferable and cannot be redeemed at future events, or on-sold to a third party. The winner of the competition must be the team captain in each event entered into.

What is the value of the prize?
Please see Item 3 in the Annexure. The total value of the prize is in Australian dollars and includes GST. The recommended retail value is provided by the supplier, and correct at the time of printing. The Promoter accepts no responsibility if the value of the prize changes.

Is there more than one winner?
There is only one (1) winner and one (1) prize pack for that winner. The prize cannot be transferred shared or redeemed for cash.

How do I claim the prize?
The prize package must be acknowledged within seventy-two (72) hours of the winner being published. If the prize remains unclaimed or the winner is unable to accept the prize (for whatever reason), the winner will forfeit their prize and will have no claim. The Promoter reserves the right to re-award at the same location such unclaimed prizes within seven (7) days of the original prize being awarded. In the event of a re-allocated winner, their details will be published on the Promoter’s website within twenty-four (24) hours of the re-award. As a condition of accepting a prize, each winner (and his/her companions) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

Is dealer pre-delivery of the bike covered in the cost of the prize?
Dealer pre-delivery of the bike is included in the prize, but the winner will be required to pick up the bike from a pre-arranged Husqvarna dealership.

What is not covered in the cost of the prize?
All expenses such as One Event Competition Licences, Temporary Club Memberships, personal transport for team members to and from the events (including but not limited to delivery, taxes and insurances) become the responsibility of the winner unless otherwise stated in the prize description in Item 3 of the Annexure. All on-road costs (including vehicle registration and insurance), statutory charges and delivery of the bike to the winner are not included in the prize. The winner will be required to pick up the bike from a Husqvarna dealership.

What will I get if the original prize is unavailable?
If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

What happens if the prize or elements of prize are damaged or lost?
The promoter and its associated agencies and companies take no responsibility if the prize is delayed, damaged or lost in transit.

Are there any tax implications?
Sometimes this may happen. You may wish to seek independent tax advice prior to accepting the prize.

What happens if I incur a loss or damage from the prize?
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia. Except for any liability that cannot by law be excluded, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize and/or participation in any holiday prize.

What can alter or prevent the competition from taking place?
The Promoter is not responsible for any incorrect or inaccurate information, either caused by:

– defects, delays and any other problems affecting technical equipment or telecommunication systems;
– infection by computer virus, bugs, technical failures or any other causes beyond the control of the Promoter;
– tampering, unauthorised intervention, fraud; or
– intervention of any outside agent or event which naturally changed the result or presents or hinders its determination, including but not limited to:
– vandalism, power failures, civil unrest, strikes
– tempests, natural disasters, acts of God.

Can I be excluded from the competition?
The Promoter can disqualify any individual who the Promoter has reason to believe has breached any of these conditions and/or engaged in any unlawful or other misconduct calculated to jeopardize the fair and proper running of the competition.

Can I cancel my Transmoto Tribe membership after entering and/or if I am the winning entrant?
If membership is cancelled at any point prior to the competition draw entrants/winner forfeits all rights to prize fulfillment. If you choose to cancel your Tribe membership after the prize draw, you will not be refunded your annual membership fee and your subscription will be cancelled for the remainder of the year.
